Terms and Conditions for Julianator

These Terms and Conditions ("Terms") govern your use of the Julianator mobile application ("App") operated by Bright Day Digital LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Julianator app on iPhone, iPad, Apple Watch or other devices, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

Julianator is a mobile application that converts between a date and day of year. It can display the current day of year in widgets and Apple Watch complications.  The App is currently available as a paid application. Pricing model is subject to change.

3. License to Use

3.1 Grant of License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on compatible devices that you own or control for your personal, non-commercial use.

4.1 App Purchase

The App is currently available for purchase through the Apple App Store. All purchases are processed by Apple and subject to Apple's Terms of Service.

4.2 In-App Purchases

At our discretion, additional features may be available through in-app purchases or subscriptions. All transactions will be processed through Apple's payment system.

4.3 Refunds

Refund requests must be made through Apple's App Store refund process. We do not directly process refunds.

5.1 Eligible Use

You must be at least 13 years old to use this App. If you are under 18, you must have parental consent to use the App.

5.2 Account Security

You are responsible for maintaining the security of your device and any account information associated with the App.

The App, including all content, features, and functionality, is owned by Bright Day Digital LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

"Julianator" and our logo are trademarks of Bright Day Digital LLC. You may not use our trademarks without our prior written consent.

6.3 User Content

Any feedback, suggestions, or ideas you provide regarding the App may be used by us without compensation or attribution.

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and protect your information when you use the App.

8. Updates and Modifications

8.1 App Updates

We may release updates to the App from time to time to improve functionality, fix bugs, or add new features. You may need to update the App to continue using it.

8.2 Terms Updates

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or App Store update notes. Your continued use of the App after changes constitutes acceptance of the new Terms.

9. Disclaimers and Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee

We do not guarantee that the App will be error-free, uninterrupted, or free from harmful components. We do not warrant that defects will be corrected or that the App will meet your requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHT DAY DIGITAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bright Day Digital LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the App or violation of these Terms.

12. Termination

12.1 Termination by You

You may stop using the App at any time by deleting it from your device.

12.2 Termination by Us

We may suspend or terminate your access to the App at any time, with or without notice, for violation of these Terms or for any other reason.

12.3 Effect of Termination

Upon termination, your right to use the App will cease immediately, but these Terms will remain in effect regarding past use.

13. Apple App Store Terms

13.1 Third-Party Beneficiary

Apple is a third-party beneficiary of these Terms and may enforce them against you.

13.2 App Store Rules

Your use of the App must comply with Apple's App Store Terms of Service and Usage Rules.

13.3 Apple's Role

Apple is not responsible for the App or any claims relating to it. Any complaints should be directed to us, not Apple.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Florida, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Florida.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bright Day Digital LLC regarding the use of the App.

18. Dispute Resolution

18.1 Informal Resolution

Before filing any formal legal proceeding, you agree to first contact us to attempt to resolve any dispute informally.

18.2 Arbitration

Any disputes that cannot be resolved informally may be subject to binding arbitration in accordance with the rules of the American Arbitration Association.

18.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
